Terms of Use (Advertisers and Users) Access to
and use of this site is provided by Sakol Publishing Ltd subject to the
following Terms and Conditions.
1. APPLICATION
These Terms & Conditions apply to any services offered on this
web-site. Placing and advertising your property through this web-site, or
placing a booking means acceptance of these Terms & Conditions.
Sakol Publishing Limited reserves the right to change these Terms and
Conditions at any time by posting changes online. You are responsible for
reviewing regularly information posted online to obtain notice of such changes.
2. CONTACT DETAILS
Sakol Publishing Limited is a Limited Company trading as Online Ad
Services with company registration number SC181384 and the registered office
address at c/o A.S. Fisher & Company, 160 Hope Street, Glasgow, G2 2TJ. We

3. PAYMENT TERMS AND TRADING POLICIES - OWNERS
i) Invoices for all products and services, including invoices
for annual renewal of services, are due and payable on presentation, and if
unpaid after 7 days may result in the appropriate web presence, Display
Listing, advertisement etc., to which it refers being removed from the website
and a £25.00 surcharge will apply for re-instatement once the outstanding
invoice is paid. Owners may request their listing be removed at any time and in
that event no refund or credit will be made and any unpaid amounts in respect
of the web presence, Display Listing, advertisement etc.will be due and payable
immediately.
ii) Owners offering our 52-week Availability Calendar programme must
ensure it is updated immediately that is required. If a booking is taken online
through the Availability Calendar programme which subsequently cannot be
confirmed by the owner, Sakol Publishing Ltd reserves the right to charge the
owner the Service Fee which would have applied had the booking been confirmed
and/or to remove the Availability Calendar from our website and in such cases
no refunds will be payable.
iii) Amounts collected from customers' credit cards, less the
appropriate service fee, will be remitted to the Owner 30 days from the date of
the transaction unless alternative payment terms have been mutually
agreed.
iv) The programme operates on an honour system and owners must
not request payment direct from customers who have booked online through the
Availability Calendar programme and have submitted their credit card details to
us. If that occurs the owner is still liable for our Service Fee and Sakol
Publishing Ltd reserves the right to de-activate the Availability Calendars
until such Service fee is paid.
v)
After registration, owners are obliged to complete their selected web presence
within 30 days by logging in to their admin area and uploading the requisite
photographs, text and information, and where appropriate, updating all
Availabilty Calendars. If after 30 days their web presence is not
completed as required then it will be removed from the site, and
in that event no refund will be payable.
4. RIGHT TO PUBLISH
Sakol Publishing Ltd reserves the right to refuse to publish any
listing, advertisement, link, or website which, at its sole discretion, it
deems to be inappropriate, or contrary to its own best interests, or if already
published, to remove such listing, advertisement, link or website, without
notice, and cannot be held responsible for any loss or damage as a result of
such refusal to publish or removal. In the event of removal any liability of
Sakol Publishing Ltd to any party is limited to the value of the fees paid by
that party to Sakol Publishing Ltd, less the pro-rata value of fees due for the
period during which the offending listing, advertisement, link, or website was
published.
5. ACCEPTANCE OF BOOKINGS
i)
No guarantee is given regarding the accuracy of any information displayed on
this website and users are advised that a booking made online is not confirmed
until a confirmation is received from the Owner. Until such confirmation is
received by the Customer no contract exists between the Owner and The
Customer.
ii) After a Customer has submitted a booking online, confirmation
must be sent to the Customer by the Owner from their Bookings Manager at their
Admin Area. A contract is concluded between the Owner and the Customer when
confirmation is received by the Customer. Only after such confirmation has been
received will Sakol Publishing Ltd process the customer's credit card for the
deposit due. It is the Owner's responsibility to ensure the accuracy of
availability and price.
6. WARRANTIES AND LIABILITIES
Sakol Publishing Limited warrants that it will use all reasonable
care and skill in carrying out its obligations under these Terms and
Conditions. All other conditions, warranties and obligations implied by statute
or common law or otherwise in any liabilities arising therefrom are excluded to
the extent permissible by law.
Sakol Publishing Limited accepts no liability for the completeness or
accuracy of any contents supplied to Sakol Publishing Limited by owners of
properties for insertion on this web site.
Sakol Publishing Limited cannot warrant the accuracy of any content
or information supplied by owner of properties and hereby disclaims any
responsibility for error, omission or inaccuracy in this material;
disappointment, negligence or damage caused by reliance on the material
supplied by the owners of properties or any failure or alleged failure in the
availability of the booking or provision of the property to include but not be
limited to bankruptcy, liquidation or cessation of trade of any company,
individual or firm which own the properties.
It
is acknowledged by the property owner that Sakol Publishing Limited makes no
warranties, representations or conditions with regard to any of the contents
whether express or implied arising by law or otherwise and which have been
supplied by the owners of properties displayed on the web site and there is no
implied warranty as to the fitness of the properties for any particular
purpose.
Sakol Publishing Limited does not accept liability for indirect or
consequential loss, loss of profits, salary, revenue, savings arising in
contract, delict or otherwise for the use of or inability to use the web site
or any of its contents or from any action or decision taken as a result of
using the web site or its contents.
Sakol Publishing Limited's liability for breach of the Terms and
Conditions is limited to the amount actually paid if any, by the Customer or
Owner for the use of the services provided by the web site.
Sakol Publishing Limited is hereby released from any and all
obligations, liabilities and claims in excess of this limitation.
7. FORCE MAJEURE
Sakol Publishing Limited is not liable for delays in performance
caused by circumstances beyond its reasonable control.
8. DATA PROTECTION
Your data will be held and/or transferred in strict accordance with
the applicable data protection laws and Sakol Publishing Limited's Data
Protection Registration and you consent to this. You may instruct Sakol
Publishing Limited not to use your data for direct marketing purposes.
9. CONSUMER RIGHTS
The consumer is entitled to his/her statutory rights and any
complaint about the property or cancellation or refund request is the
responsibilty of the property owner.
10. CUSTOMER CREDIT CARD DISPUTE
If, after processing of the customer's credit/debit card by Sakol
Publishing Lts and payment made to the Owner, the Customer subsequently
disputes that a credit/debit card transaction is accurate, correct or valid, or
if subsequently found to be fraudulent, and the credit/debit company charges
back the amount of the transaction to Sakol Publishing Ltd, the property owner
will, immediately upon request from Sakol Publishing and without delay, return
all monies paid to the property owner by Sakol Publishing Ltd in respect of
that transaction. If the dispute is then resolved in favour of payment from the
credit/debit card company, Sakol Publishing Ltd will immediately return all
monies received from the property owner.
11. CANCELLATION OF
BOOKINGS
In the event of you cancelling your holiday booking:-
a) After the deposit has been paid,
but before full payment is due, the deposit will be forfeit. b) After full
payment has been made but more than 14 days before your holiday start date, one
third of the total payment will be refunded. c) After full payment has been
made but less than 14 days before your holiday start date, no refund will be
possible.
12. JURISDICTION
This agreement shall be governed and construed in accordance with the
law of Scotland and the parties hereto submit to the exclusive jurisdiction of
the Scottish courts.
13. MISCELLANEOUS If any part of these Terms and Conditions
are found to be invalid or unenforceable by a court the remainder is
unaffected. |
